Business enterprises are continuously endangered in their existence and independence by partition of the inheritance, lack of succession after the entrepreneur, take over etc. Foundations are often used as protection against these contingencies and to realise other purposes in relation to the enterprise.
Pursuant to the literature in the German language, which deals with this form of foundations against the background of the German, Austrian and Swiss laws on Foundations, such Foundations are denominated as “Business Foundations” (“Unternehmensstiftung”). In relation to the Business Foundation there is no literature based on the Liechtenstein law on Foundations with its seventy years old tradition in the well known liberal and tax optimal environment. This deficiency should be overcome by this book.
The author with his long years of professional experience explains how a Foundation in Liechtenstein can be used for purposes in relation to business enterprises. In doing so he deals with judgements and literature on the Liechtenstein law of Foundations and with the relationship between a Foundation and a business enterprise, and considers moreover the most important literature on the Business Foundation in Germany, Austria and Switzerland.
This book is absolutely essential for those, who deal with the question, either in theory or practice, to which extent purposes in relation to business enterprises can be realised with a foundation and in particular with a Liechtenstein Foundation.
